Under the Immigration Act 2004, all organisations are required to gain proof of an employee’s right to work in the UK, so their employees can benefit from UK employment rights, such as protection against unlawful wage deductions, statutory minimum holiday pay and length of rest breaks, and to not work more than 48 hours per week as standard (unless opting out).

Our right to work checks

Our right to work checks are an accurate and efficient solution to help you adhere to regulations and complete your PES for a much smoother onboarding process. Identity documents are uploaded to our right to work check solution, and within seconds, you’ll have the results you need to proceed with your PES. When you use our right to work checks, your applicant will need to provide documents in line with the acceptable proof documents provided by the government. These include:

List A:

Acceptable documents to establish a continuous statutory excuse

These include documents such as:

  • Current or expired UK or Irish passports
  • Birth or adoption certificates issued in the UK, Channel Islands, Isle of Man, or Ireland, together with an official document giving the person’s permanent National Insurance number and their name issued by a government agency or previous employer.
  • A certificate of registration or naturalisation as a British citizen, together with an official document giving the person’s permanent National Insurance number and their name issued by a government agency or previous employer.

List B, Group 1:

Documents where a time-limited statutory excuse lasts until the expiry date of permission to enter or permission to stay

These include documents such as:

  • A current passport endorsed to show the holder is allowed to stay in the UK and is currently allowed to do the type of work in question.
  • A verified document issued by the Bailiwick of Jersey, Bailiwick of Guernsey, or Isle of Man, showing the holder has been granted limited leave.
  • A current Immigration Status Document containing a photograph issued by the Home Office with valid endorsement that the holder may stay in the UK, together with an official document giving the person’s permanent National Insurance number and their name issued by a government agency or previous employer.

List B, Group 2:

Documents where a time-limited statutory excuse lasts for six months

These include documents such as:

  • A document issued by the Home Office showing that the holder made an application for leave to enter or remain on or before 30 June 2021 together with a Positive Verification Notice from the Home Office Employer Checking Service.
  • A Certificate of Application issued by the Home Office showing that the holder made an application for leave to enter or remain on or before 1 July 2021, together with a Positive Verification Notice from the Home Office Employer Checking Service.
  • An Application Registration Card issued by the Home Office stating that the holder is permitted to take the employment in question, together with a Positive Verification Notice from the Home Office Employer Checking Service.
  • A Positive Verification Notice issued by the Home Office Employer Checking Service to the employer or prospective employer, which indicates that the named person may stay in the UK and is permitted to do the work in question.
